Admits violation, Shopee accepts to KPPU’s integrity pact

To comply with applicable regulations, Shopee has also collaborated with four local logistics services, Anteraja, JNE, and Pos Indonesia, and accelerated the on-time guarantee program.

Heaptalk, Jakarta — PT Shopee International Indonesia (Shopee) and PT Nusantara Ekspres Kilat (Shopee Express) have admitted to violating Indonesia’s Law No.5 of 1999, specifically Article 19(d) and Article 25(1)(a) related to courier services on the Shopee platform.

As part of the responsibility measure, this e-commerce company submitted a behavior modification request on June 20th, which the Commission Assembly approved by reading out the points of the Behavior Modification Integrity Pact and the requirements and obligations of behavior modification for each Respondent.

This e-commerce company agreed to various behavior modification points established by the KPPU Assembly in the session on June 25. The critical points of the requirements and obligations related to behavior modification that Shopee and Shopee Express must fulfill include:

  • This e-commerce platform will not engage in anti-competitive behavior as outlined in the Alleged Violation Report (LDP).
  • They will cease activities in their dominant position as outlined in the LDP.
  • The company is willing to provide evidence in the form of data, letters, and documents that demonstrate behavior modification to the behavior modification monitoring team.
  • They are willing to be active and cooperative in verifying and validating evidence by the provisions in Article 94 of the Supervisory Commission for Business Competition Regulation No. 2 of 2023 regarding the procedures for handling monopoly practices and unfair business competition cases.
  • Behavior modification will be monitored for a maximum of 90 working days, from July 3 to November 6, 2024.
  • Respondent 1 (Shopee) and Respondent 2 (Shopee Express) must follow the KPPU compliance program.

To comply with applicable regulations, this e-commerce company has also collaborated with four local logistics services, Anteraja, JNE, and Pos Indonesia, and accelerated the on-time guarantee program. According to the Executive Director of Shopee Indonesia, Christin Djuarto, this collaboration is an opportunity for logistics companies to provide outstanding delivery services by prioritizing operational excellence.
