Heaptalk, Jakarta — The Indonesian Government issued Minister of Trade Regulation (Permendag) No. 20 of 2024 on Tuesday (09/10) to regulate export policies. This regulation revises the Second Amendment to Minister of Trade Regulation No. 22 of 2023 on Prohibited Export Goods.
“This revision of the Minister of Trade Regulation is mandated by Government Regulation No. 26 of 2023 and is a proposal from the Ministry of Marine Affairs and Fisheries (KKP) as the supervising agency for managing marine sedimentation results,” explained Isy Karim, Director General of Foreign Trade at the Ministry of Trade.
Isy emphasized that marine sand exports can only be carried out after domestic needs have been met. He said, “The export of marine sedimentation results in the form of marine sand can be established as long as domestic needs are fulfilled and following applicable regulations.”
The regulation of marine sand exports aligns with Government Regulation No. 26 of 2023. According to Isy, the regulation addresses sedimentation issues that can reduce the capacity and support of coastal and marine ecosystems and ocean health. Additionally, regulating marine sand exports can optimize the use of sedimentation results for developing and rehabilitating coastal and marine ecosystems.
The types of marine sand that can be exported are regulated in Minister of Trade Regulation No. 21 of 2024, which refers to the Minister of Marine Affairs and Fisheries Regulation No. 47 of 2024 concerning the Specifications of Marine Sedimentation Sand for Export. Several requirements must be met to export the mentioned marine sand based on Minister of Trade Regulation No. 21 of 2024. These requirements include being designated as a Registered Exporter (ET), having an Export Approval (PE), and possessing a Surveyor Report (LS).
To be designated as an ET by the Ministry of Trade, businesses and exporters must obtain a Marine Sand Utilization Permit from the KKP and a Mining Business License for Sales from the Ministry of Energy and Mineral Resources. Additionally, businesses and exporters must submit a notarized declaration stating that the exported marine sedimentation sand comes from an approved extraction location according to the permitted coordinates.
“Once the requirements to become an ET are met, businesses and exporters can complete the conditions to obtain an Export Approval (PE). The requirements include having a Marine Sedimentation Sand Export Recommendation from the KKP and meeting domestic needs through a domestic market obligation (DMO). Meanwhile, the types of marine sand prohibited from export are regulated in Minister of Trade Regulation No. 20 of 2024,” said Isy.
In addition to Ministerial Regulation No. 20 of 2024, the Ministry of Trade also issued Minister of Trade Regulation No. 21 of 2024 on the Second Amendment to Minister of Trade Regulation No. 23 of 2023 on Export Policies and Regulations.
Both Minister of Trade Regulations were promulgated in Jakarta on August 29, 2024, and will be effective 30 working days from the date of promulgation. “We hope businesses can adhere to these regulations effectively, positively impacting Indonesia’s economy. The export provisions will come into effect 30 working days from the promulgation date,” concluded Isy.
